Landlord and Tenants Renting Rights (Part 2)

If a tenant believes a landlord/agent entered the premises without notifying him/her, or damaged the tenant's property during entry, they may:
- Seek assistance from the Consumer Affairs Section of Prices and Consumer Affairs Division;
- Seek advice/assistance from a solicitor; or
- Visit the nearest police station./li>
Rent/security money in advance
The amount of money paid by a tenant to a landlord/agent as security is to cover unpaid utilities or damage caused by the tenant to the premises.
Please note that the tenant should not use the security as the last month's rent.
How much?
The amount should be equal to one calendar month's rent. The landlord/agent must give the tenant a signed receipt.
The receipt should:
- be dated
- have amount paid
- say for what purpose
- have the name and address of the tenant.
At the end of the tenancy:
- he tenant is not entitled to use the security money to pay the last month's
rent.
- The landlord/agent must repay the security deposit to the tenant, unless -
- the tenant is behind in rent, or
- damage has been done to the premises or furniture, which is beyond fair wear and tear.
Increase in rent
A landlord or his agent may increase the rent if:
- Substantial improvements or structural alterations other than ordinary repairs are done to the property
- Suitable water supply has been provided for the benefit of the tenant.
- The rates and taxes payable by landlord/agent in respect of the land and/or house have been increased.
To end a tenancy, the landlord and tenant can either agree to do so or serve the appropriate notice.
